Conception by Turkey Baster Doesn’t Diminish a Father’s Rights

The Virginia Court of Appeals ruled on Tuesday that a woman who impregnated herself with a friend’s sperm has no right to prevent him from exercising his legal rights as the child’s father.

Since the woman took matters into her own hands with the assistance of a turkey baster and did not utilize “medical technology” as required by a Virginia Code provision that bars sperm donors from seeking custodial rights, her friend is entitled to enforce his full legal rights as the child’s biological father.

The Court’s full opinion can be read here:  http://www.courts.state.va.us/opinions/opncavwp/1250143.pdf
